Judgment of the Federal Administrative Court in Leipzig
The Federal Administrative Court in Leibzig has now made a possibly groundbreaking and sustainable verdict for the future.
In the case of serious data protection violations, privacy advocates have the right to oblige the operators to switch off the Facebook Fanpage (company page). Also, Schleswig-Holstein’s data protection officer Marit Hansen which had set the ball rolling, called the verdict as “tailwind for data protection.”
The reason for this change is due to the fact that when users call up a Facebook fanpage they collect this data to an unknown extent, without them being sufficiently informed.
The Leibziger court thus shares the assessment of the European Court of Justice, thereby giving the privacy advocates on Facebook Fanpages more rights to implement the provisions of the GDPR.
The managing director of the German Association of Chambers of Industry and Commerce (DIHK), Martin Wansleben, points to the legal ambiguity in the privacy protection in social networks that many companies that run a Facebook fan page are unsettling.
The presence in social networks is meanwhile for many companies important for the care of the customer relations. Legal conflicts between the platforms and privacy advocates should not be fought on the backs of companies in Germany.

Furthermore, Hansen expects Facebook to take responsibility as the largest social network, and draw conclusions from the verdict.
Since the introduction of the DSGVO in May 2018, many legal questions are still unclear for German companies, although it can be said that they adhere strictly to the guidelines, and until now also put a lot of money and time in their implementation to have.
The implementation seems to be more difficult with the really big data octopuses which mostly sit overseas.
In any case, it is certain that the courts will be busy for many years to clarify the open questions of the DSGVO project.
